LIMITED WARRANTY

35 YEAR TEJAS BORJA “PEACE OF MIND” WARRANTY
         
TEJAS BORJA will replace (ex-factory cost), free of charge, any tile proven to be defective during the first 35 years following its installation, excluding labour, roof tear-off, disposal, transport (and other costs related as duty taxes, FOB, inland transport etc), excluding also the costs of any flashing and metal work (and repairs required by defects therein) and of equipment such as scaffolding or cranes necessitated by the material replacement. In lieu of replacement, TEJAS BORJA at its sole discretion reserves the right to refund the amount paid for the defective tile, but not including any costs connected with installation or related transports cost, duties, inland etc...

Tiles shall not be considered defective with respect to color, shade or hue so long as the color, shade or hue at the time of installation does not vary unreasonably from the tile sample. In the event the face of any tile (other than textured tile) shall not have a smooth, even surface, the tile shall not be deemed to be defectively manufactured unless any facial imperfection shall be visible from a distance of more than 30 feet.

In the event of crazing in Glazed Roof Tiles it shall not be deemed to be defectively manufactured.


LIMITATIONS

Installation of tiles in jobs in an altitude less than 1000 feet.

This warranty covers free roof tiles that have suffered the consequences of a
hidden vice. Other costs concerning dismantling, reinstallation or transport
expenses (customs duties, inland freights, taxes etc...) are excluded of this
guarantee.

To be covered by this guarantee, roof tiles should be installed with a total dry system avoiding mortar.

TEJAS BORJA shall not be liable for, and this warranty does not apply to, any
failure, defect, or damage (including, but not limited to, crumbling, break-up, or change in color) resulting from or connected to any of the following: misuse, abuse, neglect, or improper handling or storage; installation in areas with altitude higher than 1000 feet.; impact of foreign objects, fire, earthquake, flood, lightning, hurricane, hail, tornado, or other violent storm or casualty, or other acts of God; defects in, failure of, or damage caused by, materials used as a roofing base over which the tiles are installed, or by movement, distortion, cracking, or setting of walls or the foundation of the building; exposure to harmful chemicals; or any other cause not involving inherent manufacturing defects in the material supplied by TEJAS BORJA; nor shall TEJAS BORJA have any liability under this warranty for changes in color, shade or hue caused by stains or contamination of any sort arising from outside sources (such as, but not limited to, algae, mildew, fungus, moss, lichens, or other vegetation). This warranty does not apply to tile which has been painted, varnished, or similarly coated over the manufacturer's original finish.

TEJAS BORJA, reserves the right to discontinue or modify any of its products,
including the colour thereof, without notice to the homeowner/consumer and shall not be liable to the homeowner/consumer as a result of such discontinuance or modification, nor shall TEJAS BORJA be liable in the event replacement material may vary in color intensity, and/or shade, and/or hue in comparison to the original product as a result of normal weathering. If TEJAS BORJA replaces any material under this warranty, it may substitute products designated by TEJAS BORJA to be of comparable quality or price range in the event the product initially installed has been discontinued or modified.

OTHER CONDITIONS

This warranty is expressly in lieu of all other oral or written warranties,
liabilities or obligations of TEJAS BORJA. Pertinent state law shall control for what period of time subsequent to a sale, a consumer/homeowner may seek a remedy pursuant to any implied warranty of merchantability or of fitness for a particular purpose. In no event shall TEJAS BORJA be liable for consequential or incidental damages of any kind, including any damage to the building where the tiles were installed, its contents, or any persons therein, resulting from the breach of any warranty set forth herein. No field representative of TEJAS BORJA or any distributor or dealer is authorized to make any change or modification to this warranty. Some states do not allow limitations on, or the exclusion of, incidental or consequential damages, so the above exclusions may not apply to you.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER
RIGHTS WHICH VARY FROM STATE TO STATE.

WARRANTY CLAIMS

To make a claim under this warranty, the homeowner/consumer shall notify TEJAS BORJA in writing of any manufacturing defect promptly following its discovery, and shall submit with such notification proof of date of purchase and tile installation, in order to provide TEJAS BORJA an opportunity to investigate the claim and examine the material claimed to be defective. All notifications shall be provided to: TEJAS BORJA, S.A., Carretera Lliria-Pedralba Km 3,2 , Lliria (Valencia) España. TEJAS BORJA shall promptly inspect the claimed defect before any claim for replacement material is approved, and TEJAS BORJA shall, within a reasonable time after approval, provide the replacement tile (or in lieu of providing replacement material shall refund the amount paid for the defective tile) in accordance with the terms set forth above. This warranty supersedes any written warranty or guarantee previously issued by TEJAS BORJA.
